Terms of Service

1. Acceptance of Terms

By installing FilterIQ ("we," "us," or "our") from the Shopify App Store or accessing our services, you ("you" or "merchant") agree to be bound by these Terms of Service. If you do not agree to these terms, do not install or use our app.

2. Description of Service

FilterIQ provides AI-powered product search, filtering, merchandising, and analytics services for Shopify stores. The service includes:

• A search index of your product data powered by Meilisearch
• Configurable filter interfaces with 15+ filter types
• Merchandising controls (pin, boost, demote, hide products)
• An analytics dashboard tracking search queries, click events, and filter usage
• AI-powered configuration that analyzes your catalog and builds optimal filter setups

3. Account Terms

Access to FilterIQ is granted through the Shopify App Store installation process. By installing our app, you represent that:

• You are the authorized owner or administrator of the Shopify store on which you install the app.
• You are at least 18 years of age or have the legal capacity to enter into a binding agreement.
• You are responsible for maintaining the security of your Shopify admin account, which controls access to our app.

You agree not to share your account credentials with unauthorized parties or use the service for purposes other than powering search and discovery on your Shopify store.

4. Acceptable Use

You agree not to:

• Use the service to index or search content that violates applicable laws or Shopify's acceptable use policies
• Attempt to reverse-engineer, decompile, or extract source code from our service
• Use automated tools to abuse our API beyond reasonable usage limits
• Resell, sublicense, or redistribute our service without written permission
• Interfere with or disrupt the integrity or performance of the service
• Access the service through any means other than the interfaces we provide (Shopify admin, storefront widget, documented APIs)

5. Payment Terms

FilterIQ is billed through the Shopify Billing API. By approving the charge in your Shopify admin, you authorize recurring charges at the rate specified in your selected plan.

• Free trial: All plans include a free trial period. You will not be charged until the trial period ends and you have approved the subscription charge in your Shopify admin.
• Billing cycle: Subscriptions are billed monthly through Shopify. All billing disputes should be directed to Shopify support.
• Cancellation: You may cancel at any time by uninstalling the app from your Shopify admin. Cancellation takes effect at the end of your current billing cycle.
• Plan changes: You may upgrade or downgrade your plan at any time. Changes are prorated according to Shopify's billing policies.

6. Intellectual Property

FilterIQ and all associated trademarks, logos, code, algorithms, and documentation are the intellectual property of FilterIQ and are protected by applicable copyright, trademark, and intellectual property laws.

You retain full ownership of your product data, store content, and any configurations you create. We claim no ownership over your data. By using our service, you grant us a limited license to process your data solely for the purpose of providing and improving the service.

7. Data and Privacy

Our handling of your data is governed by our Privacy Policy. By using our service, you consent to the data practices described therein. For merchants subject to GDPR or similar regulations, our Data Processing Agreement provides additional protections.

8. Service Availability

We strive to maintain 99.9% uptime for our search services. However, we do not guarantee uninterrupted access and are not liable for temporary service interruptions caused by maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance when possible.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• FilterIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our service.
• Our total aggregate liability for any claims arising from or related to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
• The service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

Either party may terminate this agreement at any time:

• By you: Uninstall the app from your Shopify admin at any time.
• By us: We may suspend or terminate your access if you violate these terms, if required by law, or if we discontinue the service (with 90 days' prior notice for service discontinuation).

Upon termination, we will delete your data in accordance with our Privacy Policy. Sections on intellectual property, limitation of liability, and governing law survive termination.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FilterIQ operates, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved through binding arbitration, except where prohibited by applicable law.

12. Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the new terms.
